Terms of Service

1. General

These Terms of Service ("Terms" or "TOS") govern the relationship between TG:ON Team ("we", "us", operator of the tg-on.com website and the TG:ON software) and the user of the Service ("you", "User").

By using the Service you confirm that you have read, understood and accept these Terms. If you do not agree with any provision — please do not use the Service.

2. Description of the Service

TG:ON is desktop software for Telegram automation that includes:

• Parser for channels, groups, and audience extraction.
• Sender with anti-ban mechanics.
• Auto-Responder, Live Inbox, AI qualifier and closer agents.
• Account manager, proxy rotation, inviter.
• Data Vault — index of public Telegram groups and channels.

3. User age

The Service is intended for users aged 16 and older. By using the Service you confirm you are at least 16. If you are younger, please do not use the Service without parental or legal guardian consent.

4. License

Upon payment for a tariff you receive a non-exclusive, non-transferable license to use TG:ON during the paid period, subject to the tariff terms.

4.1. License restrictions

• One key — two machines (standard: desktop + laptop of the same owner).
• The license is non-transferable, may not be rented or resold.
• Prohibited: reverse engineering, decompilation, attempts to crack or bypass the licensing system.
• You may not create derivative products based on TG:ON or offer them as a service (white-label, SaaS reselling) without a separate agreement.

4.2. Ownership

TG:ON (including the binary, source code, design, trademark, documentation) remains the intellectual property of TG:ON Team. The license does not transfer ownership.

5. Tariffs, payment, refunds

5.1. Tariff plans

Current tariffs: Trial $0 / Starter $49 / Pro $89 / Agency $169 (monthly). Annual plans offer a 58% discount. Feature comparison — on the pricing page and in Article 25.

5.2. Payment methods

• Bank cards via CryptoCloud.
• Cryptocurrencies (USDT, TON, BTC, ETH, and 20+ others) via CryptoCloud.

5.3. Trial

Trial access (3 days or 100 messages) is free, no card required. After expiration the Service switches to read-only mode. No automatic charges.

5.4. Refunds

• Within 14 calendar days after payment — refund available if the Service has material defects (does not launch, advertised functions do not work).
• Refunds are issued via the same method as payment. For crypto — same coin, at the exchange rate at the time of refund.
• After 14 days or if you stop using the Service for reasons unrelated to defects — no refund (standard for licensed software).
• If the Service was used to violate these Terms — no refund is issued.

6. Acceptable Use (AUP)

You agree to use the Service within the law and within reason. The following is prohibited:

• Using the Service for spam or other violations of the Telegram Terms of Service.
• Distributing malware, phishing, fraudulent offers, or pyramid schemes via mailings.
• Sending unlawful content (extremism, drugs, weapons, child sexual abuse material, etc.) — criminally punishable in most jurisdictions.
• Political campaigning in circumvention of applicable political-advertising restrictions.
• Attacking our infrastructure (DDoS, brute-force, unauthorized vulnerability scanning).
• Transferring or reselling license keys to third parties.

Violation of the AUP is grounds for immediate license termination without refund and blocking access to the Service.

7. Your responsibility for Telegram accounts

By using the Service, you confirm that you:

• Understand the risks of mass operations in Telegram.
• Accept full responsibility for the state of your Telegram accounts.
• Do not claim compensation from us in case of bans or other restrictions imposed by Telegram.

8. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, we disclaim all express or implied warranties, including but not limited to:

• Warranty of specific results (lead count, conversion, ROI).
• Warranty of uninterrupted operation — technical breaks, updates, and downtime may occur.
• Warranty of compatibility with specific Telegram-client versions, operating systems, or hardware.
• Warranty that the Service will meet all your expectations or future market changes.

9. Limitation of Liability

To the maximum extent permitted by law, our aggregate liability is limited to the amount you paid for the Service in the 12 months preceding the event giving rise to the claim.

We are not liable for:

• Indirect, incidental, consequential, or punitive damages.
• Lost profits, loss of goodwill, loss of customers.
• Data loss (you are responsible for backups — see Privacy Policy for limitations).
• Actions of third parties (Telegram, payment processor, hosting provider).
• Bans or restrictions imposed by Telegram (see Section 7).

10. Termination

We may suspend or terminate your access to the Service without prior notice in case of:

• Violation of these Terms or AUP (Section 6).
• Fraudulent actions (chargeback after successful activation, use of stolen payment instruments).
• Threats to our infrastructure or other users.
• A lawful request from competent authorities.

If we terminate the Service through no fault of yours — a pro-rata refund of the unused period, with at least 30 days' prior notice.

You may stop using the Service at any time by uninstalling the software and not renewing your subscription.

11. Changes to these Terms

We may change these Terms as the Service evolves and laws change:

• Material changes (price increase, AUP changes, restriction of rights) — notified by email and via @tgon_support_bot at least 14 days before they take effect.
• Minor changes (typography, clarifications) — marked with "Updated [date]" at the top of the page.

By continuing to use the Service after changes take effect, you confirm acceptance of the new version. If you disagree — discontinue use; a pro-rata refund may apply.

12. Governing law and dispute resolution

• For users from Russia and CIS — Russian Federation law applies.
• For users from EU/EEA — mandatory consumer-protection rules of the country of your residence apply where they conflict with these Terms.
• For other jurisdictions — Russian Federation law applies unless mandatory local law provides otherwise.

Parties shall first attempt to resolve any dispute through negotiation via support@tg-on.com. If that fails — court proceedings at the operator's location.

13. Miscellaneous

• Severability. If any provision of these Terms is held invalid, the remaining provisions remain in effect.
• No waiver. Our failure to immediately enforce a provision is not a waiver.
• Entire agreement. These Terms together with the Privacy Policy and Cookie Policy constitute the entire agreement between the parties.
• Assignment. We may assign our rights under these Terms in the course of reorganization, business transfer, or other succession.
